Postbird Terms of Use

These Terms of Use (“Terms”) govern your use of the Postbird Linux application and related website, documentation, and services (collectively, “Postbird”), provided by Otron Pty Ltd (“we,” “us,” or “our”). By downloading, installing, or using Postbird, you agree to these Terms. If you do not agree, do not use Postbird.

1. What Postbird provides

Postbird is a desktop email client that connects to Google’s Gmail API after a user grants permission through Google OAuth. It lets users view and manage their own Gmail accounts through a desktop interface.

Postbird is an independent application. It is not made, endorsed, or sponsored by Google. Gmail, Google, and related marks belong to Google LLC.

2. Eligibility and authority

You may use Postbird only if you are legally able to agree to these Terms. You must have authority to access every Google account you connect. If you use Postbird for an organization, you represent that you have authority to bind that organization and comply with its security, records, and acceptable-use requirements.

3. Your Google account

You remain responsible for your Google account, credentials, messages, recipients, attachments, and actions taken through Postbird. You must protect access to your computer, system keyring, and Google account. Notify Google and postbird@otron.com promptly if you believe an account or token has been compromised.

You can revoke Postbird’s Google access at any time through your Google Account settings. Some local Postbird data may remain until you delete it as described in the Privacy Policy.

4. Acceptable use

You must not use Postbird to:

  • access an account or data without authorization;
  • send spam, phishing, malware, unlawful material, or unsolicited bulk messages;
  • harass, deceive, defraud, or violate another person’s rights;
  • bypass Gmail limits, filters, safety measures, or Google policies;
  • interfere with Postbird, Google APIs, networks, or other users;
  • distribute malicious modifications while misrepresenting them as an official Postbird release; or
  • use Postbird in violation of law, Google’s terms and policies, or third-party rights.

5. Your content and instructions

You retain your rights in messages, attachments, and other content. You instruct Postbird to transmit and process that content only as needed to perform actions you choose in the app. You are responsible for ensuring that your content, recipients, and instructions are lawful and appropriate.

Mailbox actions can have real effects. Sending a message, moving mail to Trash, archiving, applying labels, or marking mail read or unread changes your Google account. Review recipients and attachments before sending.

6. Privacy

Our handling of information is described in the Postbird Privacy Policy, which is incorporated into these Terms by reference. Google and other third parties process information under their own terms and privacy policies.

7. Software availability and changes

Postbird may be updated, changed, suspended, or discontinued. Features can stop working because of changes to Gmail, Google APIs, OAuth requirements, Linux distributions, desktop libraries, or other dependencies outside our control. We do not guarantee uninterrupted operation, delivery timing, synchronization timing, or compatibility with every system.

8. Third-party services and content

Postbird depends on Google services and may display third-party email content, remote images, links, and attachments. We do not control or endorse third-party content or services and are not responsible for their availability, accuracy, security, or practices. Use caution when opening links and attachments.

Your use of Google services remains subject to Google’s applicable terms and policies.

9. Open-source components

Postbird includes open-source software components governed by their respective licenses. If Postbird source code or releases are distributed under a separate software license, that license governs copying, modification, and distribution of the software; these Terms govern use of the associated application and services to the extent legally permitted.

10. Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTBIRD IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, ACCURACY, OR RELIABILITY.

Postbird is not intended for emergency communications or situations where delayed, missing, duplicated, incorrectly displayed, or incorrectly processed email could cause death, personal injury, significant property damage, or other critical harm.

Nothing in these Terms excludes a warranty, guarantee, or consumer right that cannot legally be excluded.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTRON PTY LTD AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, EMAIL, PROFITS, REVENUE, BUSINESS, GOODWILL, OR OPPORTUNITY, ARISING FROM OR RELATED TO POSTBIRD.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATED TO POSTBIRD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR POSTBIRD DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) AUD$1.

These limitations do not apply where prohibited by law.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Otron Pty Ltd and its contributors from claims, losses, liabilities, and reasonable costs arising from your unlawful use of Postbird, violation of these Terms, or infringement of another person’s rights.

13. Suspension and termination

You may stop using Postbird at any time. We may restrict access to any developer-operated service or distribution channel if reasonably necessary to address unlawful use, security risk, policy violations, or legal obligations. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limitations, and dispute terms.

14. Governing law and disputes

These Terms are governed by the laws of [Queensland/Australia], without regard to conflict-of-law principles. Courts located in Queensland, Australia will have exclusive jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere.

Before filing a claim, you agree to contact postbird@otron.com and attempt in good faith to resolve the dispute informally for at least 30 days, unless urgent relief is required.

15. Changes to these Terms

We may update these Terms. The current version will be posted at https://otron.com/postbird-terms-of-use with a revised “Last updated” date. Continued use after an update takes effect constitutes acceptance where permitted by law. If you do not agree to an update, stop using Postbird.

16. General

If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, reorganization, or transfer of Postbird. These Terms and the Privacy Policy form the entire agreement concerning their subject matter unless another written agreement applies.
